12.12.2018 Tier 1 (Investor) Visa Route will not be suspended
On Tuesday 11 December, the Home Office has reversed a decision to suspend Tier 1 Investor Visa programme, less than a week after the Home Office announced it would close the scheme because of concerns it might be making it easier for corrupt business individuals and government officials to launder money through the UK.
The reversal took place after the Home Office received a warning letter from Immigration Law Practitioners’ Association (ILPA) stating that the suspension of the Tier 1 (Investor) visa was illegal and would lead to a legal challenge if the department failed to rescind the planned changes.
The Home Office confirmed in its statement that the Tier 1 (Investor) visa was “not currently suspended”, however, it is committed to reforming the scheme to make it more strict and effective in tackling money-laundering.
The department declined to explain why it decided to reverse its decision so soon after the announcement of suspension.
Immigration Law Practitioners’ Association (ILPA) said it was “extremely disappointed” by the quick change. The department had not followed usual practice and did not give a sufficient notice of the upcoming changes, “the situation in our view makes a mockery of the principles of certainty and stability that are inherent in the rule of law,” said the ILPA.
