From 1 February 2016 all private landlords will be obliged to conduct “right to rent” check in respect of their prospective tenants. The landlords will have to check that the tenants have a right to remain in the UK before renting a property to them.
Immigration Act 2014 brought about this ‘right to rent’ check. Section 22 of the Act states that a landlord must not authorise an adult to occupy premises under a residential tenancy agreement unless the adult is lawfully present in the UK pursuant to immigration laws.
Landlords who do not make a ‘right to rent’ check will face a civil penalty of up to £3,000.
